Where parties executed a binding Agreement as to Compensation and Indemnity that expressly provides interest is payable and that the rate is to be determined by the Director (Clause 2) and contains a clause excluding Tribunal claims on determination of compensation (Clause 4), the Lands Tribunal lacks jurisdiction to determine a claim for interest under sections 8(2) and 17 because the applicant accepted a section 6(1)(a) offer and is not a person entitled under section 8(2).
