Where a defendant succeeds in striking out substantial parts of a claim but a substantive claim under statute remains which may be remitted or retried, the court should award costs for the struck-out parts (and for the strike-out summons) to the defendant while leaving costs of the remaining claim in the cause to await ultimate determination.
