On the facts and background the 1st Letter was at least an arguable s23(3) acknowledgement of the defendant's liability as guarantor and was at least arguably admissible because it sought indulgence of an admitted liability rather than negotiation of a disputed liability; therefore the plaintiffs' claims could not be struck out as plainly unsustainable and the appeal had to be dismissed.
