The court refused to determine the limitation issue on affidavit evidence at interlocutory stage because material factual disputes (including what was said at the 21 January 2000 meeting and whether entries were communicated to the plaintiff) require oral evidence and cross-examination; accordingly the limitation defence must be determined at the trial when all factual disputes can be resolved.
