The Vice President's order striking out the Notice of Appeal in CACV 360/2005 was set aside because a single judge does not have jurisdiction under section 35(1) High Court Ordinance to make an order that has the effect of determining the appeal; remaining issues including the constitutional challenge to the leave requirement and other renewal matters are to be determined at the substantive hearing for efficiency and because mixed questions of law and fact are better resolved at that hearing.
