Where a company failed to lay accounts within the statutory period, subsequent attempts to put those accounts before members do not change the date on which the breach occurred; accordingly no new prosecution risk is created by those attempts and orders are unnecessary for periods where the breach is already beyond the prosecutable timeframe.
