The Court of Appeal allowed the appeal on the single issue of the four month closure: contemporaneous expert/contractor evidence (contractor letter and consultant engineer advice) that unexpected underground flooding required dredging and drainage works, heavy machinery and closure for safety and insurance reasons justified closure as reasonably necessary; the trial judge was plainly wrong to find closure unnecessary.
