The court quashed the Commissioner's decision because the Presiding Officer sent undisclosed, prejudicial comments to the Commissioner urging the appeal be dismissed, thereby breaching fairness and impartiality; the Presiding Officer's failure to consider the defence of reasonable self‑defence also caused substantial prejudice. Those defects warranted certiorari and quashing of both the disciplinary finding and the Commissioner's dismissal of the appeal.
