Leave to appeal was refused because the intended grounds lacked reasonable prospects of success: the plaintiff's challenges were inconsistent or raised late, the judge was entitled to decide issues of plagiarism where that meaning was pleaded, factual findings were supported by documentary evidence and permissible inferences, and the defences of justification and fair comment were properly addressed including absence of malice.
