The court revoked/dismissed the applicant's leave to appeal application as an abuse of process because the correct procedure to challenge the provisional costs order was an application to vary under Order 42 rule 5B(3); accordingly the provisional costs order stands and the applicant must pay the respondents' costs, to be assessed summarily.
