The court exercised clemency and allowed the appeal against sentence because the appellant's pregnancy and the prospect of first childbirth in custody constituted exceptional circumstances; having served approximately two and a half months, continued imprisonment was unnecessary for deterrence and therefore the concurrent 12‑month sentences were set aside and replaced by immediate release and repatriation to Mainland China.
