The magistrate's interventions were legitimate assistance to an unrepresented defendant and did not deny justice; the appellant made no reasonable enquiries and thus failed to establish the statutory defence under s.63(5); despite imprecise language the correct reasonable-diligence test was applied; and the sentencing magistrate lawfully exercised discretion under s.63(7) to impose a HK$4,500 fine which was not manifestly excessive and fell within statutory limits.
