KAMBROOK DISTRIBUTING PTY LTD v. JACK LIGHT INDUSTRIAL CO LTD AND OTHERS

    Citation
KAMBROOK DISTRIBUTING PTY LTD v. JACK LIGHT INDUSTRIAL CO LTD AND OTHERS
    Court
    Court of First Instance
    Case number
    HCA2737/1984

The K10 must be regarded as a single integrated product for the facts of this case; admissions by the defendant that the body, egg poacher and suspended basket were copied amount to reproduction of a substantial part of the plaintiff's work and entitle the plaintiff to relief in respect of those admitted parts; however, on close comparison the defendant did not reproduce a substantial part of the plaintiff's handle or lid — similarities were at the level of idea or function rather than protected form — therefore no infringement as to handle and lid.
