The lump sum award was set aside because it was outside the scope of the wife's application and would be unjust without notice or reservice; the variation of maintenance to $1,000 per month was upheld as within the judge's discretion and reasonable on the evidence and having regard to s.5(c).

The court found the marriage valid as a Chinese customary marriage but dismissed the wife's application because the acts did not establish cruelty of a persistent and grave character and, since the parties were living apart by mutual consent with no express or implied agreement to maintain, there was no liability on the husband to provide maintenance.
