The Court followed Hunter J (Panalpina) that a 'claim for a sum of money' under the Labour Tribunal Schedule can include unliquidated damages arising from breach of employment contracts and therefore the High Court action was struck out as within the Labour Tribunal's jurisdiction; however, because the Labour Tribunal has no power to grant an injunction, the Court retained and modified the asset-freezing injunction as an urgent interlocutory measure.
