The surveyor's verification was reviewable and was erroneous because he extended the existing requirement for a service lane (which under Reg 28 applies only to domestic buildings) to a proposed wholly commercial redevelopment; Reg 23(2)(a) must be applied in the context of Reg 28 so the Set Back area must be included in site area for wholly commercial redevelopment and the surveyor's deduction of that area was a material legal error open to challenge.
