The court found that sale of the placed shares on the open market was clearly in breach of the lock-up undertakings but declined to finally determine the effect of the agreements involving Lantau and Squadron because the status of Squadron and the application of Bahamian law to pre-incorporation acts required clarification; accordingly the matter was adjourned for further evidence and argument on those issues.
