Although the 1st Defendant's solicitors were at fault for not applying earlier, the Master erred in refusing leave because the plaintiff suffered no irremediable prejudice that could not be compensated by costs, and the procedural rules permitted supplementation of evidence; accordingly leave to file the witness statement out of time was properly granted.
