The Court held Powick remained the beneficial owner of the vessels for the purposes of section 12B(4)(i) despite the Singapore voluntary winding up; the Court preferred the Linter/Franklin analysis over Ayerst for the effect of liquidation on title; proceeds of sale pendente lite stand in place of the ship so subsequent writs validly invoke in rem jurisdiction; any technical service/amendment defect was cured; accordingly all jurisdictional challenges failed and the motions were dismissed with costs.
