The appeal was dismissed because the judge did not err in law or fact: the alleged apparent bias failed the Locabail test as the arbitrator was unaware of and had only minimal prior contact with the applicant so a fair‑minded informed observer would not infer a real possibility of bias, and, critically, the applicant's challenge was inordinate and unjustifiably delayed such that the judge rightly declined to extend time to set aside the award.
