The court set aside the summary assessment because the respondent had not been served with the statement of costs and thus lacked an opportunity to be heard; the respondent's supporting affidavit filed two days late was admitted as the delay was short and unobjected to; on reassessment the court allowed $24 for photocopy charges, $1,000 for preparation and $1,400 for perusal, totaling $2,424, and declined to make an order on costs of the 26 November and 16 December applications because of the respondent's partial success and his responsibility for delay.
