Leave to appeal was refused because the judge correctly found the judgment to be regular, the defendant delayed nine months before applying to set it aside, and no demonstrable flaw in the exercise of judicial discretion on costs was shown to justify departing from the normal practice that the applicant bears costs.

No stay was granted because the judge was not satisfied that a binding settlement had been reached; the master did not err in refusing to make an Unless Order because the defendant's failure to pay was not shown to be contumacious or to have hampered the proceedings; accordingly the appeal/application was dismissed with no order as to costs.

Service by post to the address for service was technically effective; the 9th defendant produced no documentary evidence and gave inconsistent accounts as to sums paid; she had no real prospect of establishing a proprietary interest or actual occupation that would have put the plaintiff on notice; therefore the judge correctly refused to set aside the default judgment and the appeal was dismissed.

The Court refused the application to adduce further evidence because there was no evidence the plaintiff sought an adjournment and therefore no reasonable diligence; on the appeal the Court found that the judge below was not plainly wrong to conclude the defendant had a reasonable prospect of success given the inconsistencies and the contemporaneous documents, and therefore dismissed the appeal.
