Because Order 22 r.23 mandates indemnity costs consequences where a plaintiff fails to obtain a better result than an unaccepted Part 22 payment and the court did not consider such an order unjust in the circumstances, the defendant was entitled to indemnity basis costs from 26 November 2021 and the defendant's application to amend the provisional costs order was granted; the costs of the present applications were not awarded on an indemnity basis but ordered to be paid by the plaintiffs jointly and severally on the ordinary basis and to be assessed with the main action.
