The Court of Appeal held the trial judge's acceptance of the official allotment resolution was not plainly wrong and dismissed the plaintiff's appeal on allotment; but on the share transfer issue the judge had no proper pleaded or evidential basis to invalidate the transfers by relying on an unpleaded finding of the deceased's lack of intention and the circumstantial evidence was not compelling enough to prove forgery.
