The court concluded the Intervener had had a fair opportunity to oppose via the evidence and submissions filed in relation to the stay application and that deciding the Originating Summonses on paper was consistent with Order 1A r1 and r2(2); accordingly the Intervener's applications to stay and for leave to appeal were dismissed, but leave to appeal and a stay were granted to the 2nd Defendant in HCMP 801 and 802 because the court had mistakenly proceeded on an assumption of the 2nd Defendant's neutrality and thereby deprived it of the opportunity to oppose orders made against it.
