The Court dismissed the appeal because the trial judge’s detailed credibility-based findings were supported by the evidence: the Father retained control and beneficial ownership, the 1995 restructuring and later allotments were nominee/trust arrangements rather than gifts conferring beneficial ownership to Ken, the 2006 allotment to Ken of Pak Tat shares was made to confer apparent authority and was held on trust for the Father, and no palpable errors vitiated the judge’s conclusions.
