Given the deceased was a short‑term casual worker who started work only days before the accident, s11(2) (latter limb) applies; evidence established daily wage HK$1,300 and the applicant’s credible testimony established average 20 working days per month; monthly earnings therefore HK$26,000 (HK$1,300 x 20); applying s6(1) multiplier 36 and adding s6(5) funeral expenses HK$46,621.40 produced total judgment HK$982,621.40; judgment apportioned 50% to applicant and 50% to mentally incapacitated daughter with the daughter's share to be paid into court; interest and costs ordered as directed.
