The Court upheld the trial judge's factual findings that the plaintiff reached MMI by March 2009, there was no objective evidence of persistent muscle wasting or CRPS1, and that the plaintiff had adopted an abnormal sick role caused by his personality rather than by the accident; accordingly causation was broken for losses flowing from that sick role and the trial awards were adjusted: PSLA and pre-trial loss awards were upheld, but future loss of earnings and caregiver awards were varied as set out.
