A renewed application for bail under s83Y(3) is an entitlement but absent a material change of circumstances it is not appropriate for the full Court to finally determine renewed bail applications before the substantive appeal; such renewals should ordinarily be heard at the hearing of the appeal and new grounds not previously considered by the single judge should not be advanced at renewal.

A single judge may order loss of time when an application for leave to appeal is hopeless, but where counsel or a solicitor has advised that an arguable ground exists and has settled grounds of appeal it is unfair to make such an order against the lay client; nevertheless the full court on a renewed application may still consider hopelessness and order an appropriate loss of time. The confessions were held admissible and the convictions were supported by the evidence.
