The court held it had jurisdiction to vary the Order Nisi prior to sealing. The prior tenders of HK$28,000 did not constitute full and final settlement and therefore did not negate interest accrual on the larger sums; interest was recalculated with specific accrual periods and rates. Because the Plaintiff beat its sanctioned offer and there was no counter-offer, the Plaintiff was entitled to enhanced interest and costs. Specific orders were made specifying periods and rates for interest and awarding costs on party-and-party to 30 March 2010 and indemnity thereafter, taxed if not agreed.
