The appeal was not entertained on its merits because there was no prior reasoned decision by the probate master following a hearing; the proper course is to remit the matter to a probate master to consider the full affidavits and evidence, and to direct a hearing where requisitions remain unresolved; legal opinion and certificates cannot replace evidential affidavits.

The stay pending a Legal Aid application was refused because the application was made too late due to the plaintiff's solicitors' failure to advise the client about costs and Legal Aid eligibility; the trial period is a milestone not to be adjourned absent exceptional reason, therefore the action proceeds and the solicitors must continue on record and instruct counsel without placing costs on account.

The ex parte application for a warrant of arrest was refused because the plaintiffs' solicitors provided no information that the vessel was or was about to be in Hong Kong and ex parte warrants require full disclosure and good reason; solicitors must actively monitor vessel movements and cannot rely on automatic issuance of warrants or on the Marine Department and bailiff to track vessels.
