On the facts the solicitor (Mr. Keung of K.B. Chau & Co.) was in serious default by failing to make reasonable enquiries into the plaintiff's financial position and by permitting an ex parte Mareva injunction supported by a misleading affirmation; this serious misconduct caused the defendant to incur unnecessary costs and, under Order 62 r.8, the solicitors must indemnify the defendant for those costs.
