On a holistic assessment of contemporaneous records, witness evidence, video recordings and expert opinion, the Court was satisfied on the balance of probabilities that the Deceased had testamentary capacity when she executed the 2nd Will on 6 March 2014 and the Plaintiff failed to prove actual undue influence; accordingly the 2nd Will is valid, the Grant stands, and the Plaintiff's claim is dismissed.
