No evidence showed the solicitors could not competently and professionally represent defendants or that Kwan's public comments created disqualifying unfairness; even if counsel were potential witnesses the applicant could cross‑examine them and still obtain a fair hearing; allegations of scheduling or lateness did not amount to grounds for disqualification; therefore the summons and appeal lacked legal basis and must be dismissed.
