The plaintiff was ordered to pay the defendants' costs of the action and the costs of the defendants' summons to be taxed on an indemnity basis with a certificate for counsel because the plaintiff failed to obtain a better result than defendants' early offers and the case was hopeless in light of disclosed BOM records; however, there was insufficient evidence that the plaintiff's solicitors connived in falsity or committed conduct amounting to abuse of process, so a wasted costs order against the solicitors was refused.
