The correct construction of Order 67 rule 6 is that a solicitor must have ceased to act before issuing a summons to come off the record; because Deacons had not ceased to act when they issued the summons the Master lacked jurisdiction and his order of 19 August must be set aside. The court exercised discretion to allow the appeal but declined to make costs orders.
