Leave to appeal was refused because the issue of solicitors' liability was clearly in the solicitors' favour: the solicitors acted for existent, competent clients who authorized the proceedings, and on application of the Nelson v Nelson principles and the leave-filtering purpose of s.14(3)(e) the solicitors cannot be held liable; accordingly the defendant's summons was dismissed and no leave granted.
