There was no evidence before the trial judge to establish negligence on the part of the defendant; given the circumstances (vehicle well clear of a stopped maxicab, no unsafe speed shown, and no evidence of failure to keep proper lookout) the defendant had no duty to sound his horn or to reduce speed to guard against a pedestrian suddenly running into his path; the trial judge's finding of negligence was unjustified and is set aside.
