Because the lawfulness of the licensing provisions was genuinely in doubt, there was insufficient evidence of deliberate flouting or real, imminent harm from the broadcasts, and given the exceptional nature of civil intervention to aid criminal law, the court exercised its discretion to refuse continuation of the injunction pending final determination of the constitutional issue.
