On the evidence accepted by the magistrate the appellant had a reasonable basis for believing the speed limit was 70 km/h at the point he passed the laser gun; having established that reasonable mistaken belief on the balance of probabilities, the defence succeeded, the conviction could not stand, and the appeal is allowed.
