Section 13 Cap 492 authorises awards of costs where an appeal is without merit in relation to one or more convictions; the discretion is to be exercised on all the circumstances, allowing costs against partially successful appellants. Applying that discretion and discounting costs attributable to a reasonably arguable s25 construction point, the court ordered the first and second appellants to pay 40% of the respondent's appeal costs, taxed if not agreed, excluding sentencing-related costs.
