The court accepted the plaintiff's evidence and found that the defendant (Poon) had not established adverse possession because his case depended on an alleged agreement and payment to Mr Li rather than an intention to possess to the exclusion of the true owner; evidence showed the land was vacated and not continuously occupied. Accordingly judgment for vacant possession was entered for the plaintiff and adverse possession was not established.
