The director did not have authority under the 1992 Staff Manual to permit excess over-time compensation leave and that claim is dismissed; however the director had the delegated discretionary authority under the Staff Manual to permit accumulation of excess annual leave in special circumstances and by his conduct he impliedly permitted the plaintiff to accumulate such annual leave, binding the employer; accordingly plaintiff entitled to judgment for annual leave pay of HK$29,420.89 with interest from 27 March 1997.
