The Notice of Motion for leave to appeal to the Court of Final Appeal was dismissed because the applicant failed to identify any question of great general or public importance, merely re-argued points already decided, and offered no basis under the 'or otherwise' limb of section 22(1)(b).

The High Court allowed the appeal and quashed the convictions because the magistrate, having accepted corroborative evidence that the appellant was waiting to meet his girlfriend, failed to evaluate how that factor affected the credibility of the police evidence; that omission left a lurking doubt as to the safety of the verdicts.
