The magistrate's factual findings that the dog was kept in the appellant's flat, that the barking caused the complainant annoyance amounting to a reasonable-person intolerance, and that the appellant therefore 'kept' the dog were supported by evidence and within the magistrate's province; accordingly the conviction under Cap.400 s5(3) and s5(5) was safe and the appeal was dismissed.
