The 2nd Defendant did not sign the purported Guarantee; the questioned signature was forged. The 2nd Defendant discharged the evidential burden to raise forgery and the Plaintiff failed to discharge the legal burden of proving genuineness given cogent forensic evidence of forgery and corroborating inherent probabilities; accordingly the claim against the 2nd Defendant is dismissed and costs follow the event.
