The court held that "notifiable" in clause 14.5 required a mandatory obligation to notify and SARS became notifiable on 27 March 2003 when added to the First Schedule of the Quarantine and Prevention of Diseases Ordinance; coverage under clause 14.5 and the date of loss therefore commence on 27 March 2003; the Loss Period is limited to 180 days from the date of loss and the reference to resumption is inapplicable where the business did not cease; Standard Revenue is calculated by reference to the 12 months immediately preceding the date of Damage (i.e. prior to 27 March 2003).
