The applicants are not 'creditors' within s765(1) because they possess no pecuniary claim against the company; the ordinary company‑law meaning of 'creditor' requires a monetary or pecuniary obligation and the statutory language cannot bear extending to persons with proprietary or in rem claims such as adverse possessors.
