The Court of Appeal held the judge correctly applied the established 'bona fide dispute on substantial grounds' test to a winding-up petition founded on an arbitral award, found there was a bona fide dispute given the dubious features of the Supply Agreement and consensual Award, and affirmed dismissal of the petition without standing it over to await any setting aside of the Award.
