Section 52A must be given a liberal construction; Florens was a party to the High Court action and the court retained jurisdiction to make complementary costs orders notwithstanding earlier orders against the defendants; on the facts Florens funded, supported and causally enabled the defendants' resistances and stood to benefit, so in the exercise of the court's discretion it was just to order Florens to pay the shortfall of the plaintiffs' costs.
